1. Is a Buyers Guide displayed in a prominent, visible location on every used vehicle offered for sale, as required by the FTC Used Car Rule (16 CFR Part 455)?
2. Is the Buyers Guide in the correct format — using the FTC's required language and layout — with no material omissions or non-compliant substitutions for the required disclosure text?
3. Is the Buyers Guide completed before the vehicle is displayed or offered for sale, with all required fields completed accurately for each individual vehicle?
4. Does the Buyers Guide correctly indicate whether the vehicle is sold 'As Is' (no dealer warranty), 'With Warranty' (dealer warranty provided), or 'Certified Pre-Owned' (if applicable) for each vehicle?
5. Where a dealer warranty is provided, does the Buyers Guide accurately describe the warranty coverage — systems covered, duration, and percentage of repair costs covered by the dealer?
6. Is the 'As Is' disclosure clearly and prominently displayed for vehicles sold without warranty, with the customer's acknowledgement obtained that no warranty is provided?
7. Is the Buyers Guide retained in the deal file after sale, with a copy provided to the buyer and a copy retained by the dealer for the minimum required period (at least 2 years from date of sale)?
8. Is the Buyers Guide translated into Spanish (or another language if that is the language principally used in the sale negotiation) where required by the FTC Rule?
9. Is the Buyers Guide placed in the vehicle in the required location (attached to the vehicle — window, dashboard, or another prominent location) and not removed until after the sale is completed?
10. Are used vehicles inspected before the Buyers Guide is prepared, with known defects or issues considered in determining whether a warranty is offered and on what terms?
